What Counts as Whistleblowing in California?
California Labor Code §1102.5 protects you if you reported — or were believed to have reported — a reasonable suspicion of unlawful conduct. That includes fraud against the government or shareholders, Cal/OSHA violations, healthcare or billing fraud, SEC/SOX/Dodd-Frank violations, wage theft, or refusing to participate in illegal activity. You don't have to be right that a law was broken — only that you reasonably believed it was.
Retaliation doesn't require proof that your complaint was "correct." It only requires that you had a reasonable, good-faith belief that something unlawful was happening.
The timing matters. If adverse action happened shortly after your protected activity, that pattern alone can be powerful evidence. Courts know that employers rarely admit to retaliating — the facts tell the story.
